Please read these Terms & Conditions ("Terms") carefully before purchasing any original artworks, prints, or products from edwinkmorris.art. By placing an order, you agree to be bound by the terms outlined below.

1. No Returns & No Refunds Policy (All Sales Final)

  • All Sales Are Final: Due to the custom, delicate, and one-of-a-kind nature of original art, limited prints, and custom-produced goods, we do not accept returns, exchanges, cancellations, or issue refunds once an order has been submitted.

  • Color & Representation Disclaimer: We make every effort to display the colors, textures, and details of artworks as accurately as possible. However, because computer monitors, phone screens, and ambient lighting vary, the physical piece may exhibit subtle color variations compared to digital displays. These variations do not qualify as defects or grounds for a refund.

2. Damaged in Transit (Exceptions & Claims)

While sales are strictly final, we take great care in packaging works securely. If your piece arrives damaged during shipment:

  1. Notification Window: You must contact us within 5 business days of carrier delivery at info@e-e.art.

  2. Required Documentation: Include your order number, clear photographs of the damaged artwork, and photos of the external packaging and shipping label.

  3. Resolution:

    • Original Artworks: Because original paintings cannot be reproduced or replaced, damaged originals will be evaluated on a case-by-case basis (options may include insurer claim processing or professional restoration where feasible).

    • Prints & Merchandise: At our sole discretion, an approved claim for damaged print or merchandise items will be replaced with an identical reprint. Cash refunds will not be issued.

3. Copyright & Intellectual Property

  • Artist Retains All Rights: The purchase of any original artwork, print, or merchandise does not transfer copyright, reproduction, or licensing rights to the buyer.

  • No Commercial Use: All rights, including moral rights and reproduction rights, remain exclusively with Edwin K. Morris / E&E Art. Artwork may not be copied, scanned, resold for licensing, minted as digital tokens/NFTs, or incorporated into commercial projects without express written permission.

4. Shipping, Delivery & Lost Packages

  • Fulfillment: Orders are dispatched to the shipping address provided at checkout. Please verify your address prior to completing the transaction; we are not responsible for shipments sent to incorrectly entered addresses.

  • Tracking & Risk of Loss: Title and risk of loss pass to the buyer upon handover to the shipping carrier (USPS, UPS, FedEx, or freight handler). We provide tracking details upon dispatch.

  • International Orders / Customs: Buyers are solely responsible for any applicable customs duties, import tariffs, or value-added taxes (VAT) levied by their local authorities.

5. Pricing & Product Availability

  • All prices are listed in USD.

  • We reserve the right to modify prices, update product descriptions, or discontinue items without prior notice. In the event an item is mistakenly listed at an incorrect price or has sold out before inventory syncs, we reserve the right to cancel the transaction and issue an immediate payment void/reversal.

6. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising out of purchases made on this site shall be resolved in the state or federal courts located in Florida.
